In a judgement with a far reaching implications,Jharkhand High Court today quashed all the four fodder scam cases lodged against former Bihar Chief Minister Jagannath Mishra.
Justice R R Prasad passed the order while hearing the matter and quashed the cases 38A/96, 47A/96, 64A/96 and 68A/96 lodged against the former Bihar CM.
Mishra’s counsel, Nityanand Jha pleaded before the court that former CM was already convicted under case 20A/96 and facts presented in cases 38A/96, 47A/96, 64A/96 and 68A/96 were same as placed in the case under which Mr Mishra was convicted.
Pleading before the court the lawyer prayed that once the accused was convicted he should not beĀ punished under case based on similar facts.
However, the CBI lawyer, M A Khan opposed the argument of Mishra’s counsel who submitted that the accused had committed identical crime in four different places and as such was liable to be punished.
But Justice Prasad quashed the four cases lodged against Mishra.
This means that all other accused including Rashtrya Janata Dal President Lalu Prasad Yadav,who were convicted in one fodder scam case and faced four other cases mentioned above,can cite the verdict of Justice Prasad and get relief.
