Ever since Asaram Bapu has been accused of raping a minor, many issues arose regarding the age of the victim, consent as well as her mental stability. Asaram faces charges of rape for manipulating a woman’s body with the intention to rape.
With the amendment in rape laws, after brutal Delhi Gang Rape Case, such an act is included in the ambit of rape.
On Monday, the bail plea of self -proclaimed Godman Asaram was heard by the Rajasthan High Court in Jodhpur. While the matter is still pending, the Lower Court has extended the judicial custody of Asaram till September 30, 2013. The prosecution will present its arguments on September 18, 2013 for rejection of the bail plea.
As reported by India Today, senior Advocate Ram Jethmalani today described the victim as a mental case.Jethmalani also alleged that she was suffering from mental disorder.Though he did not mention the name of the mental disorder,he said that she wanted to meet Asharam alone.
“This psychological condition is making her desire to meet men alone,” Jethmalani said.
However, it is likely that prosecution will argue that Asaram took the advantage of the victim despite knowing the fact that she is mentally unstable.
The victim’s mother was also questioned by Jethmalani for maintaining silence for so long despite having the knowledge about the alleged assault.
Police Commissioner of Jodhpur B.G. Joseph said he would ensure a strong case against Asaram. The time frame for police to file a charge sheet is 90 days from the day of arrest. Any delay is filing the same would provide Asaram an advantage in seeking bail.
Asaram was arrested on August 31, 2013 by Jodhpur Police.
